Is Your Public Entity On Track to Comply with DOL Overtime Regulations: Tips and Techniques for Re-Classification, Policies, Procedures and Handling Previously Exempt Employee Frustration

Overview

While this webcast is open to all EIA members, some of the Eyres Law Group Services are only available to members of the PWC and/or GL1 programs.

This webinar will focus on complying with the new FLSA overtime regulations, effective December 1, 2016. We will focus on the core practical issues involved in reclassifying employees who will no longer be exempt from overtime, due to the significant increase in the “salary basis test” and what it means for public employees.

  • Do your job classifications accurately distinguish between exempt and non-exempt employees?
  • Do job descriptions match the job classification, and if not how to remedy the situation… quickly, even when job descriptions must be negotiated.
  • Should you raise salaries to keep individuals who work extensive hours in exempt status?
  • Alternatively, should you convert currently exempt supervisors to hourly and then restrict overtime? What impact will MOUs have on the reclassification process?
  • Do you have a process in place for managing overtime for employees who are reclassified from exempt to non-exempt?
  • Are you prepared to address morale and frustration among employees who are newly “demoted” to hourly workers.
  • Strategies for re-evaluating career tracks for entry level supervisors who must remain hourly workers.
  • Hidden pitfalls in compensation plans when compensation compression hits your front line leaders.
  • New or enhanced policies your departments will need in order to assure that newly non-exempt employees – and their managers – understand the ramifications of overtime expended on reading and replying to electronic communications on mobile devices.
