Beyond Disability: Reasonable Accommodation Requirements in Employment and Public Accommodations

We last presented a webinar on this topic on March 25, 2015. . We now have more than a year of regulatory and judicial interpretations; particularly in the areas of reasonable accommodations for religious practices, gender identity and expression, victims of domestic violence and stalking, and military service. This webinar is completely updated with the latest case law and regulations for 2016, with an emphasis on government workplaces.

 

When the term “reasonable accommodation” is used, the first (and often the only) issue that HR professionals focus on is disability. Yet, in California we have a variety of new requirements for conducting an interactive process and evaluating reasonable accommodation decisions. 

Learning Objectives

In this very important webinar we will cover the following specific issues:

  • Breaking news update: Understanding the breadth and limits of the new California Court of Appeals case expanding California FEHA to require reasonable accommodating employees who, though not themselves disabled, have an “association” with a disabled person;
  • The key requirements for reasonably accommodating employees and job applicants based on religious expression and observations, including the impact of the US Supreme Court 2015 Abercrombie & Fitch decision;
  • How to conduct and document an interactive process based on religious practices, beliefs and dress or grooming practices and the latest on the increasing concerns about religious harassment stemming from dress and grooming accommodations;
  • Gender identity and expression in the public identity worksite. Special issues for accommodating access to facilities and resources and why California law hasn’t resulted in the high profile media attention:
  • Federal and state law differences and similarities with respect to gender identity and expression in public schools, public facilities and the workplace;
  • Balancing religious freedom with accommodations for employees and the public;
  • An update on how reasonable accommodations are effectively implemented for employees who are experiencing domestic violence and stalking; employees who are experiencing domestic or relationship violence or stalking, including a specific process for addressing these issues constructively;
  • How to address co-worker concerns and strategies for managing delicate issues in a diverse workgroup or department;
  • Handling the flow of information during and after the interactive process and how to supplement your interactive process manual in areas unrelated to disability.
