Conducting Internal Complaint and Misconduct Investigations: Finding the Truth Without Breaking the Law

Overview

While this webcast is open to all EIA members, some of the Eyres Law Group Services are only available to members of the PWC and/or GLl programs.

This webinar is completely updated for current federal and California standards. Dealing with workplace complaints - from racial bias to sexual harassment to threats of violence - is a huge part of your job as an HR professional. You're dealing with a double-edged sword: You have a clear legal duty to investigate complaints promptly and resolve them fairly - but if you make any mistakes along the way, you could wind up in even more hot water than when you started.

Additionally, in today’s climate more public agencies are identifying other potential acts of misconduct, such as dishonesty, misrepresentations concerning leave entitlement, misuse of district resources or equipment, policy violations or lapses of integrity and even outright theft. Before taking disciplinary action, a solid investigation plan should be designed and implemented.

  1. The most common types of accusations, complaints, and misconduct that require an investigation;
  2. How to document the initial complaint or report of misconduct and establish the scope of your investigation;
  3. The step-by-step components of a lawful, successful workplace investigation, including how to handle increased scope of complex investigations;
  4. Tips for dealing with “sticky situations,” including sensitive information and embarrassing allegations;
  5. Identifying appropriate witnesses and key documentation;
  6. Coping with large amounts of potential relevant digital data;
  7. Unique issues when investigating “whistleblower” complaints involving claims of legal or ethical violations within government agencies;
  8. Effective questioning and assessing witness credibility;
  9. How to ease fears of retaliation by complainants and witnesses;

  15. How to sidestep retaliation charges before, during and after the investigation;
  16. Effective documentation and… What about the Public Records Act?
