Public agencies are coping with a new reality in many aspects of their workplace – including the financial impact of significant budget shortfalls for the new FY 20-21.

As a result of the coronavirus pandemic, many employers are being forced to make tough workforce decisions to deal with the significant economic impact and uncertainty. This webcast will focus on the logistics of layoffs, the pros and cons of furloughs vs. permanent layoffs, management strategies and effective communications during and in the aftermath of reductions-in-force from both physical distancing/public health and financial imperatives.
The presentation will address:

1.    Legal compliance requirements for public entities and school districts when undertaking layoffs;

2.    Identifying the legally appropriate reasons to conduct a layoff, job elimination or other reduction in workforce during the pandemic (e.g., financial budget cuts, lack of work for specific positions, etc.)

3.    The federal and state regulatory environment, the impact on labor contracts and relations, anticipated ongoing challenges as the pandemic peaks and ebbs in many counties;

4.    Distinguishing between furloughs or layoffs and strategies for making concrete decisions in the midst of COVID-19 uncertainties;

     a.    Specific examples of the “pros and cons” of implementing a furlough vs. a layoff or job elimination and how to select the approach that best meets your workforce requirements.

     b.    Integral aspects for implementing a furlough, including retaining key personnel, flexibility to respond to operational continuity requirements.

     c.    When and how to recall employees who were furloughed, based on operational considerations, COVID 19 community spread, or immediate budgetary pressures.

     d.    How to recognize when a furlough must convert to a layoff or job elimination.

5.    Tackling telework options in the midst of COVID 19 spikes:

     a.    what to do when employees on reduced hours furloughs must be pressed into service 

     b.    how to handle unpredictable absences by employees who test positive or are exposed.

     c.    Legal requirements and restrictions for employees performing remote work while on furlough or mandated COVID leave.

6.    How to sidestep employment law landmines during reductions in force from employees with disabilities, leave entitlements, or retaliation protections;

7.    What to do when seniority is a key factor in layoffs, and yet the most senior employees may be those on longer term leave or reasonable accommodation plans due to COVID-19 considerations;

8.    Coping with claims of retaliation or leave interference during financially required layoffs;

9.    Impact of periodic operational interruptions or mandated shutdowns on employees’ seeking and receiving unemployment benefits

10.     Strategies to keep your leaders managing, not litigating.
