Legislative Update for Public Entity Health Care Providers for 2016

Overview

This 90 minute training will include a brief review of new legislation, both State and Federal, effective in 2016, impacting public entity health care providers and/or their patients in public health, mental health, substance use disorder, hospital or correctional care settings.  It will also review proposed legislation that will likely impact us going forward.

 

Learning Objectives:

  • Who must sign up for the CURES 2.0 website and when they must do that
  • How to answer patients' questions about the End of Life Option Act, including specific details regarding its implementation
  • What the Medical Marijuana Regulation and Safety Act covers and new regulations pertaining to "medical marijuana"
  • Details of the new birth certificate and declaration of intended parentage laws
  • Numerous new licensure laws impacting the health care professions
  • Records retention periods for the various disciplines, including retention periods for minor records
  • The new release of information to attorneys form that health care providers must honor when signed by their patients
  • Mental health training for law enforcement
  • New 5150 laws that impact how holds are initiated and lifted, including proposed legislation to close some of the gaps in the involuntary mental health hold laws
  • The recent Notice of Proposed Rule-making that outlines major proposed changes in 42 CFR Part 2 confidentiality rules for substance use disorder programs
  • Proposed federal laws that could impact mental health privacy laws in California
  • Responding to data breaches and confidentiality concerns including several examples of recent privacy breaches
  • Other miscellaneous new laws of interest to health care providers, including immunizations for child care providers, opt out choices for parents, child safety seats, mandated reporting of child abuse, provider directories, conservator's powers regarding visitors, and proposed legislation that will impact prescribing of psychotropic medications for foster youth
