Overview

While this webcast is open to all EIA members, some of the Eyres Law Group Services are only available to members of the PWC and/or GL1 programs.

This webinar will provide a fast-paced overview of the key issues facing employers and claims professionals as we move into 2016 and beyond.

Learning Objectives

As promised, this follow up webinar is will drill down to the details. In addition to a review of real world examples and best practices, this webinar will include:

  • Update on California legislation passed, pending and defeated, including yet another bill the sponsor claims will prevent gender discrimination in apportionment;
  • Updated regulations for OSHA injury reporting, heat illness, drug testing and more;
  • Updated on case law, including apportionment, liens, RTW;
  • Industrial injury claims and chronic pain: the good, the bad and the ugly;
  • Ongoing efforts, through legislation and public policy to reduce injured workers’ dependence on prescribed opioids for pain management;
  • The impact of medical marijuana on managing both the workplace and workers’ comp claims, including substance abuse testing;
  • Update on the impact of obesity on the management and resolution of industrial claims;
  • The impact of distracted driving and equipment operation on industrial injury claims and how to minimize potential serious injuries through training, safe work practices and policy enforcement;
  • How advances in medical treatment impact claims costs and early RTW programs;
  • The “good faith personnel action defense:” Do’s and Taboos for managers and supervisors when documenting discipline and managing performance while an employee is on temporary modified duty;
  • The  rapid rise of mental health claims based on alleged bullying, abusive conduct, harassment or other “offensive” conduct in the workplace and what to do about it”
  • Why internal investigations of bullying or abusive conduct are critical (yes- even with denied WC claims) and how to document the workplace investigation separately from the claims investigation; and then document corrective action that helps – not hurts –  the resolution of the industrial injury claim;
  • Managing continuous trauma claims and post—termination claims;
  • Update on best practices for managing Early RTW programs for injured workers with temporary disabilities.
