Minors and the Law 2018

Overview

Minor Consent will answer the question, "When can minors give consent for their own treatment and when must a parent, guardian or some other adult consent for their care?"

 

We will cover the following four main areas of concern:

 

1.  Consent Basics

  • Legal, Physical and Mental Capacity
  • Informed Consent
  • Consent in an Emergency

2.  Minor Consent

  • Sensitive Services
    • Any Age Minor:  Pregnancy, Sexual Assault, Rape
    • Age 12 and older: Infectious Diseases, STDs, Mental Health/SUD Counseling`
  • Emancipated Minors
    • Married
    • Military
    • Court Order
  • Self-Sufficient Minors

3.  Parent/Guardian/Other Adult Consent

  • ​Biological Parent, Including Parent Under the Age of 18
  • Adoptive Parent
  • Married vs. Unmarried Parent
  • Divorced Parent (Sole or Joint Custody)
  • Registered Domestic Partner Parent
  • Delegated Authority to Another Adult
  • Caregiver's Affidavits

4.  Dependents/Wards of the Court​

  • ​The Court
  • Foster Parents, Social Services
  • Probation Officers
