Impact of California's Legalization of Recreational Marijuana on Drug-Free Workplace Standards and Workplace Conduct

Overview

While this webcast is open to all EIA members, some of the Eyres Law Group Services are only available to members of the PWC and/or GL1 programs.

Now that California voters have approved the legalization of marijuana for recreational uses, employers should focus on how, if at all, this will affect a broad range of issues in the workplace. The intent of Prop 64 is to decriminalize the adult use of marijuana for recreational purposes, but employers still have rights and responsibilities to maintain drug-free workplaces. Employers are NOT required to permit the use, possession, consumption, transparent display, sale of marijuana in the workplace. Federal laws and regulations that impose criminal sanctions will still apply and workplace safety will remain a paramount concern for all employers.

This webinar will focus on how to assure that your existing policies protect your agency and enforce disciplinary standards for violation. We will cover:

  1. How to enforce your current policies and enhance your procedures
  2. How will Prop 64 affect public agency employers with in-place Drug Free Workplace Policies?
  3. How will Prop 64 affect employers with drivers who are subject to DOT testing and enforcement protocols?
  4. What to do if you don’t have an updated Drug Free Workplace Act policy and procedure?

  5. How will Prop 64 affect your drug testing protocols? How to vet, and if necessary, update your protocols.

  6. How to detect and address policy violations in your workplaces, including triggers for drug testing, fitness for duty, responding to workplace accidents and consistent application of relevant procedures.

  7. Relevant information to distribute to your front line administrators, managers and supervisors concerning the impact of Prop 64 on their workplace management and how to respond to employee questions.

  8. The impact of Prop 64 on existing medical marijuana standards in California and how to address frequent questions regarding RTW, stay at work and related issues.

  9. Critical components to add to your communication and outreach with all employees, staff, contractors and others, including on-site, off-site and other locations where employees work, congregate or socialize.

  10. How to determine whether you need to supplement your agency’s disciplinary policies for workplace behavior
